Welcome to Build a CubeSat! The terms “we”, “us” and “our” refer to Build a CubeSat. Build a CubeSat operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Build a CubeSat is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”) describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not use or access our Services.

Section 1 – Access and Account

By using our Services, you represent that you are at least the age of majority in your country of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own or manage.

You may be asked to provide certain information (e.g. email, billing, shipping, and payment details). You represent that all information is current, correct, and complete. You are responsible for maintaining the security of your account credentials and all activity under your account.

We make every effort to represent products accurately. However, colors and product appearance may differ depending on your device and settings. All product descriptions may change at any time without notice, and we reserve the right to discontinue products or limit quantities at our discretion.

Section 3 – Orders

When you place an order, you are making an offer to purchase. Orders are only accepted once we confirm and process your payment. We may decline or cancel any order in our discretion.

Orders are subject to our Refund and Return Policy. Please review it carefully before purchasing.

Products are sold for personal use only and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts, and promotions may change without notice. Unless otherwise stated, prices do not include taxes, shipping, or import duties.

International customers are responsible for any customs duties, VAT, or import fees in their country.

You agree to provide accurate billing and payment information. By submitting payment details, you warrant that you are authorized to use the chosen payment method.

Section 5 – Shipping and Delivery

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events outside our control.

Risk of loss passes to you once products are handed to the carrier.

Section 6 – Intellectual Property

All trademarks, logos, text, graphics, images, and other content on the Services are owned by Build a CubeSat or its licensors and protected under Swiss and international law.

You may use the Services for personal, non-commercial purposes only. No license or right is granted except as expressly permitted by us.

Section 7 – Optional Tools

We may provide access to third-party tools or services. These are provided “as is” without warranties or liability. Any use is at your own risk.

Section 8 – Third-Party Links

The Services may contain links to third-party websites. We are not responsible for their content, policies, or practices. Please review third-party policies before engaging in any transaction.

Section 9 – Relationship with Shopify

The Build a CubeSat store is powered by Shopify, but all sales are made directly between you and Build a CubeSat. Shopify is not responsible for any transactions. You release Shopify and its affiliates from all related claims.

Section 10 – Privacy

Your personal information is collected and processed in accordance with our Privacy Policy and Shopify’s Privacy Policy. Because the Services are hosted by Shopify, your information may be processed outside Switzerland/EU.

Section 11 – Feedback

If you submit reviews, ideas, or feedback, you grant us a worldwide, royalty-free license to use them for any purpose. You warrant that you own or have rights to the content you submit.

Section 12 – Errors, Inaccuracies, Omissions

We may correct errors or inaccuracies and cancel orders if necessary.

Section 13 – Prohibited Uses

You may not use the Services for unlawful purposes, to infringe IP rights, to harass or harm others, or to upload malicious code. We may suspend or terminate access for violations.

Section 14 – Termination

We may terminate or restrict your access to the Services at any time. Provisions relating to intellectual property, liability, indemnification, and governing law will survive termination.

Section 15 – Disclaimer of Warranties

Products are covered by a 2-year warranty under Swiss law, except for those explicitly marked as Experimental or Prototype, which are provided as-is and without warranty. For details, please see our Refund Policy.

Section 16 – Limitation of Liability

To the maximum extent permitted by law, Build a CubeSat and its affiliates will not be liable for any indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability for gross negligence, intent, or where liability cannot otherwise be excluded under Swiss law.

Section 17 – Indemnification

You agree to indemnify and hold harmless Build a CubeSat and its partners from any claims arising from your breach of these Terms or violation of any law.

Section 18 – Severability

If any provision is found unenforceable, the remaining provisions will remain in force.

Section 19 – Waiver; Entire Agreement

These Terms, together with referenced policies, are the entire agreement between you and us. Failure to enforce any right does not waive it.

Section 20 – Assignment

You may not assign your rights without our prior consent. We may assign these Terms without notice.

Section 21 – Governing Law

These Terms are governed by Swiss law. Venue and jurisdiction lie with the courts of Bern, Switzerland.

Section 22 – Headings

Headings are for convenience only and do not affect interpretation.

Section 23 – Changes to Terms

We may update these Terms from time to time. Material changes will be notified in accordance with applicable law. Your continued use of the Services after changes means you accept them.
